Project Description

Background: The San Francisco Arts Commission is seeking a qualified vendor to fabricate, install, and maintain a series of two temporary artworks for the Southeast Treatment Plant Headworks Facility Construction Fence Temporary Public Art Program for the 2023 and 2024 program years (January 2023 – December 2025). The artworks will be displayed on a 600’ construction fence located in front of the Southeast Treatment Plant (SEP) Headworks Facility on Evans Avenue between Rankin and Phelps Streets in San Francisco’s Bayview neighbourhood for two consecutive years. In addition to providing the temporary artwork fabrication, installation, and maintenance services, vendor will host an annual 6-week artwork fabrication internship through an established City internship program that will support the development of professional and technical skills related to the pre-production, production, and implementation of the temporary artwork.

Maximum Cost: A contract awarded pursuant to this RFP shall have a not to exceed (“NTE”) amount of $90,000 for the initial term. Should the contract be extended, the NTE may proportionally increase as well.

Desired Start date: February 1, 2023

Anticipated Contract Term: The anticipated contract term resulting from this RFP may last up to 2 years, with the option to extend the contract for up to 1 additional year. Actual contract term may vary, depending upon service and project needs at the City’s sole, absolute discretion.

City Proposer Communications: There will not be a Pre-Proposal Conference for this RFP. Proposers are specifically directed NOT to contact any employees or officials of the City other than those specifically designated in this RFP and its Attachments. Unauthorized contact may be cause for rejection of proposals at the City’s sole and absolute discretion.

Intent of RFP: It is the intent of the Arts Commission to select the most responsive and qualified Proposer to negotiate a contract to fabricate, install, and maintain a series of two temporary artworks for the Southeast Treatment Plant Headworks Facility Construction Fence Temporary Public Art Program for the 2023 and 2024 and to provide an annual 6-week artwork fabrication internship, as described above. Proposer is not guaranteed a contract.

Scope of Services per Program Year:

  • Provide support to artist regarding digital file preparation, scaling, and reproduction of their temporary artwork.
  • Production of three (3) sets of UV resistant mesh final banners with total dimensions not to exceed 5’ x 480’.
  • Production of two (2) temporary artwork description signs measuring 36” x 48”.
  • Installation of the finished artwork on the construction fence.
  • Maintenance of the artwork consisting of a full replacement (de-installation and re-installation) of the artwork banners every four months after their initial installation over the course of one year.
  • Hosting annual 6-week artwork fabrication internship.

Redact Confidential or Proprietary Information:  All documents under this solicitation process are subject to public disclosure per Section 67.24 of the San Francisco Administrative Code, “The San Francisco Sunshine Ordinance of 1999.”  Proposals to RFPs, contracts, and all other records of communications between the City and Proposers shall be open to inspection immediately after a contract has been awarded.  Nothing in this Administrative Code provision requires the disclosure of a private person's or organization's net worth or other proprietary financial data submitted for qualification for a contract or other benefit until and unless that person or organization is awarded the contract or benefit.  Proposers may mark for redaction any confidential or proprietary information, as appropriate, prior to submitting a Proposal to this RFP.  Proposers should clearly indicate net worth or other proprietary financial data that the City should redact should the RFP Proposal be publicly disclosed, in accordance to Section 67.24 of the San Francisco Administrative Code.

City Communication Following Receipt of Proposals:  The City may contact the Proposers for clarification or correction of minor errors or deficiencies in their Proposals prior to deeming a Proposal as non-responsive. Clarifications are “limited exchanges” between the City and a Proposer for the purpose of clarifying certain aspects of the Proposals, and do not give a Proposer the opportunity to revise or modify its Proposal. Minor errors or deficiencies are defined as those that do not materially impact the City’s evaluation of the Proposal.

Terms and Conditions for this Request for Quotes:

  • There is no guarantee of a minimal amount of work or compensation for any Proposer selected for contract negotiations.
  • The City reserves the right to accept other than the lowest price offer and to reject all proposals.
  • The selection of any Proposer for contract negotiations shall not imply acceptance by the City of all terms of the Proposal, which may be subject to further negotiation and approvals before the City may be legally bound thereby. 
  • The City, in its sole discretion, has the right to approve or disapprove any staff person assigned to a firm’s projects before and throughout the contract term. The City reserves the right at any time to approve, disapprove, or modify proposed project plans, timelines and deliverables.
  • If a satisfactory contract cannot be negotiated in a reasonable time with the selected Proposer, then the Arts Commission, in its sole discretion, may terminate negotiations and utilize additional contractor solicitation and/or selection methods, or it may determine that no contract or project will be pursued.

Selection Process

Selection Criteria (30 points):

  • Staff Capabilities (10 points, 2 pages maximum): List the individual staff you propose to have work on this project, their level of effort, and their roles. Briefly summarize their qualifications, experience providing services comparable to those requested under this RFP.
  • Experience (15 points, 2 pages maximum):  Description of the vendor’s structure and capabilities as they relate to the technical requirements of the project, as well as supporting an annual artwork fabrication internship;
  • Cost proposal for 2 years of program (5 points, 2 pages maximum): Proposal budget encompassing both program years that includes the cost for the production and maintenance of the temporary artwork banners, as well as internship program participation fee of $6,000 per year.

Questions & Answers

Frequently Asked Questions for Construction Fence Temporary Artwork Program

A.

Individuals may qualify as long as they are able to perform the requested scope of services, and are willing to become a registered City Supplier and enter into a P-600 Professional Services Contract with the City.

A.

The vendor must carry Commercial General Liability and Auto insurance as required by the City. If the vendor has employees, it must also carry Workers Compensation insurance, as well as meet the requirements of the City’s Minimum Compensation and Health Care Accountability Ordinance.

Due to the scale of the artwork and requirements of the site, only mesh vinyl may be used for the temporary artwork banners.

A.

The artists for the 2023 and 2024 program years have already been selected and approved by the Commission. Once installed in the Fall of each program year, the artist’s artwork banners are to be fully replaced every four months until the following Fall when the next artist’s work is installed.

It is expected that the vendor will invoice only for work that has been performed (as costs are incurred). The vendor payment schedule for each program year will be negotiated as part of its contract with the City.

Eligibility

Doing Business with the City:  The selected vendor will need to register as a supplier with the City, enter into the City’s standard Professional Services Agreement, and carry insurance as required by the City.

Companies Headquartered in Certain States: This contract is subject to the requirements of Administrative Code Chapter 12X, which prohibits the City from entering into contracts with a Proposer that (a) has its headquarters in a state that has enacted a law that perpetuates discrimination against LGBT people and/or has enacted a law that prohibits abortion prior to the viability of the fetus, or (b) will perform any or all of the work on the contract in such a state. Chapter 12X requires the City Administrator to maintain a list of such states, defined as “Covered States” under Administrative Code Sections 12X.2 and 12X.12.  The list of Covered States is available on the website of the City Administrator (https://sfgsa.org/chapter-12x-state-ban-list).
